Ready, willing and able purchaser

A contract phrase that can make you liable for the agent's fee once they introduce a buyer prepared to exchange, even if you then decide not to sell.

If an agency contract uses the phrase 'ready, willing and able purchaser', the agent may be entitled to commission as soon as they find a buyer willing and able to exchange contracts on your terms — whether or not the sale goes ahead. Agents must explain the term in writing under the Estate Agents (Provision of Information) Regulations 1991.

Many sellers prefer contracts where the fee is payable only on completion. Ask for this wording to be removed or changed before you sign.
