In short
You can sell a rented home with tenants staying, usually to another landlord, or end the tenancy first and sell with vacant possession to any buyer. In England the Renters' Rights Act 2025 replaced 'no-fault' section 21 notices with a ground for possession when the landlord wants to sell, with longer notice. Check the current GOV.UK guidance before serving anything; rules in Scotland, Wales and Northern Ireland are different.

Choose your route
Selling with tenants in place narrows the buyer pool but keeps the rent coming in.
- Tenants in situ: marketed to investors, priced on rental yield as much as on comparable sales.
- Vacant possession: open to owner-occupiers and first-time buyers, usually a higher price, but rent stops and you carry the empty home.
- Talk to your tenants early. Co-operative tenants make viewings easier and some may want to buy.
Paperwork a buyer will ask for
Investors buying with tenants in place check compliance closely.
- The current tenancy agreement and any renewals.
- Deposit protection certificate and the prescribed information you gave the tenant.
- Gas safety record (renewed every 12 months) and electrical safety report (EICR, every 5 years).
- EPC — rented homes in England and Wales normally need a rating of E or above.
- Rent statement showing payments and any arrears.
- Any licence your council requires (HMO or selective licensing).
Viewings and the tenancy
Tenants have a right to quiet enjoyment of the home.
- Give the notice the tenancy agreement requires before each viewing (at least 24 hours in writing is the usual minimum).
- Agree viewing slots with the tenant rather than imposing them.
- If you are seeking possession, use the correct notice and ground for your nation and keep proof of how you served it.
- Do not accept a completion date that depends on tenants leaving until they have actually left.
Our take
Selling with tenants in place is often underrated. If the tenancy is well documented and the rent is at market level, an investor buyer can be faster and less fussy than a first-time buyer, and you avoid months of an empty home.
